Second Harvest Food Bank's Surplus Food Program helps to eliminate some of that waste by receiving surplus food from manufacturers, distributors, supermarkets, processors, and brokers and distributing that food to those in need. A great deal of food cannot be marketed by its manufacturer due to product overruns, off specifications, short-dated products, reformulations, mislabeled and unlabeled packaging, and discontinued brands, but is perfectly suitable for human consumption. This is where Second Harvest steps in. THE GOOD SAMARITAN ACT (EMERSON FOOD DONATION ACT) Because the various states had many different laws affecting liability as it pertains to food donation, the Good Samaritan Act was passed to provide protection to manufacturers and distributors which donate product. It gives protection for food and grocery products that meet all quality and labeling standards imposed by federal, state, and local laws and regulations even though the food may not be readily marketable due to appearance, age, freshness, grade, size, surplus, or other conditions. The law protects both companies and individuals who act in good faith. Exceptions are noted for gross negligence, but donors will not be subjected to civil or criminal liability arising from the "nature, age, packaging, or condition or apparently wholesome food." TAX BENEFITSSecond Harvest Food Bank issues a donation receipt for every donation it receives. Section 170(e)(3) of the Internal Revenue Code states that a corporation is entitled to a tax deduction with respect to a contribution to a public charity or to a private operating foundation. By offering tax deductions, the government is encouraging donations to charities. All food donors should consult with the accountants when applying appropriate deductions.
